Morgan's cavalry January 19, 1863, as volunteer aide-de-camp, first brigade. He was then made commander of scouts and afterward, on April 12, 1861, captain and adjutant-general of Duke's brigade, Morgan's Cavalry, serving as such during the celebrated Ohio raid and being captured in July, 1863. For fifteen months he was held as a prisoner of war, until specially exchanged in the latter part of 1864, when he rejoined the command in southwest Virginia. After the capture of Richmond he served for a time as major and assistant adjutant-general to General John C. Breckenridge, and disbanded with the command at Woodstock, Georgia. During the war he was wounded five times, but no disability has resulted therefrom." (The sentence where it reads afterward on April 12, 1861 I assume was a typographical error and should have read April 12, 1863).

Below Auburn they met Federal cavalry and charged; the enemy had prepared an ambuscade, which Quirk's men saw in time to avoid—but not so Quirk, Davis and Tom Murphy, who being splendidly mounted, were ahead. Into it, through it they went. Quirk unhurt—Davis wounded and captured, and Tom Murphy escaping with what he described 'a hell of a jolt,' with the butt of a musket in the stomach. Davis some how managed to escape, and reached our lines in safety, but with a severe flesh wound in the thigh." Captain Davis became afterward Assistant Adjutant General of the first brigade."
