Will of WILLIAM OFFUTT 3rd; ca 1729-1810

In the Name of God Amen, I, WILLIAM OFFUTT (the third) of Montgomery County and State of Maryland being weak of body but of sound and disposing mind and memory (blessed be God) and Calling to mind the uncertainty of this Transitory life do make, publish and pronounce this my last Will and Testament in manner and form following. To wit:

Item: My Will is that my Just Debts and Funeral charges be first paid and Satisfyed,

Item: I give & bequeath unto JAMES OFFUTT, my son, one half of my part of a Tract called "Wm. & James", and the other half where my dwelling now stands to my son OZGOOD, to be equally divided between, as also one other Tract or parcel of land called "Addition to "Wm. & James" to be equally divided between them, JAMES & OSGOOD, the whole to them, their heirs and assignees forever. The said tract called "Addition" to be divided in such a manner that OZGOOD shall possess the improved part and in case that they should disagree in the division of sd Land now divided, they shall choose two sinsible descreet men of understanding to divide the same and in case they disagree the men so chosen may call a third for that purpose to prevent disputes.

Item: I give & bequeath unto my son THOMAS OFFUTT JUNIOR all my part of a Tract of Land called "Jame's Park" in two parts, the first beginning at the end of the 4th line of the Original the Other beginning for the same at the end of the 12th line of the Original Tract, the courses and distances by the Deed will fully appear, as also one other Tract or parcel of Land called the "Young Man's Folly' to him, his heirs and assigns forever.

Item: I give & bequeath unto my son OSGOGD, one Negro man called Frank, one Negro man called Mingo,, and one Negro woman called Crispy, and all her future children, also all my Household and Kitchen furniture and all my plantation utensils after my wife's decease, she having quiet and peacible possession of the aforesaid Negroes and all the Movables above mentioned and also all the rest of my personal property during her natural life, she making no wilful waste of the same - to him, his heirs and assigns.

Item: I give & bequeath unto my Granddaughter ELIZABETH LUCKETT) of Ozgood) One Negro Girl called Beck (after my wife's decease) to her, her heirs and asigns forever.

Item: I give & bequeath unto my Granddaughter. MARY ANN, One Negro Girl called Henny (after my wife"s decease) to her, heirs & asigns.

Item: I give & bequeath unto my Granddaughter Sarah WEST (of Thomas) one Negro Girl called Sall, to her, her heirs and assigns forever.

Item: I give & bequeath unto my Grandson FIELDER,, son of George H. Offutt (after my wife's decease) One Negro Girl called Matilda.

Item: I give & bequeath unto my sons THOMAS & JAMES and my daughter, ELIZABETH. all the rest and residue of my Estate in whose possession or any where may or shall be found (that have not been mentioned and devised to be equally divided between them, their heirs and asignees forever.

Lastly my Will and desire is and do make ordain and Constitute and appoint my sons JAMES OFFUTT & THOMAS OFFUTT, Junr. my sole executors of this my last Will and Testament in trust for the intent and purposes within contained.

In Witness thereof I, the said WILLIAM OFFUTT (the third) have to this my lost Will and Testament set my hand and affixed my seal -- day of --- one Thousand seven hundred and ninty five.

Codicil:

In witness whereof I have to this my Codidil set my hand and seal this twenty third day of April, one Thousand seven hundred and ninety five, (23 April 1795)

Montgomery County Courts On the 23 dau. of August 1810, came WILLIAM OFFUTT of JAMES and SAMUEL MAGRUDER, two of the subscribing witnesses to the within last Will and Testament of WILLIAM OFFUTT the 3rd. late of sd County, deceased and severally made Oath on the Hole (sic) Evangels of Almighty God that they did see the testator therein named sign and seal this Will and that they heard him publish, pronounce and declare the same to be his last Will and Testament that at the time of his so doing he was to the best of his apprehension of sound and disposing mind and memory and understanding and that they respectively subscribed their names to this will as witnesses in the presence and at the request of the Testator and in the presence of each Other and also in the presence of the other subscribing witnesses thereto.
