An article in a Montgomery County Newspaper includes a clipping from 21 Aug 1863 which states: A NEGRO SHOT - Information has reached us that a negro man, who obtained his freedom upon the decease of the late Thomas Levi Offutt, Esq., of this county, was shot on Sunday last, by Thomas Marshall Offutt, son of said deceased, on his premises near the river crossroads. It appears that this negro was in the habit of prowling about the plantation of Mr. Offutt, who had repeatedly warned him to desist from the practice. On the day above specified, the negro was ordered off by Mrs. Offutt's wife, whom he defiantly disobeyed; whereupon her husband appeared with a shot-gun, and pretty well peppered the contumacious colored gentleman, who has since been conveyed to the Almshouse, near this town, where, we are told, he is doing as well as can be expected.

Based on the article above it would seem that the 1869 date of death is probably the more likely one.
