James Offutt      Will

I, James Offutt, of Ray County, in the State of Missouri, Do make this my last will and testament, hereby revoking any will heretofore made.
The substance of this my last will is as follows:-
     1st: I desire that after my death my funeral expenses as well as all other just debts, shall be paid and that after all my property and effects of every kind, except as hereinafter named, shall remain and continue in the possession of my wife, Leannah Offutt, during her widowhood, but if she should marry again,, then my will is, that she shall have 1/3 part of said estate during her natural life.
     Secondly. That my property and effects, both real and personal be disposed of as follows, to - wit:-
     To the children of my son, James H. Offutt, deceased,, I give my tract of land near Camden known as a part of the bluffton tract of land, and also $ 300.00 after the death of my wife.
     To Gustavus Clements, I will and bequeath $ 100.00, It being his full share in my estate.
     To my three grandchildren, William and James Winsor, and Eliza Loyd, formerly Eliza Winsor, $ 50.00 each and no more.
     To William A. Carroll, I will and bequeath my negro boy "Tobin" and no more.
To Littleton Offutt, I will and bequeath my negro boy "Daniel " and that he have possession of him immediately after my death,, and I also will to him my negro girl, Malinda. and her increase, if any,, and to have possession of her after the death of my wife.
To the children of my son, Esli Offutt, deceased, I will and bequeath my negro boy Major, and also the sum of Two Hundred Dollars.
To James Borthick I will and bequeath my negro boy Baylon and negro girl Phillis, and no more.
To the children of Samuel Offutt, deceased, my grand children, I will and bequeath my negro boy Isham and also the tract of land on where my son Samuel lived and died.

I also will and direct that after the death of my wife the tract of land on which I now live and also the tract known as Island Tract be sold and that the proceeds, after the legacies herein named,, and all just demands and expenses shall have been paid, the balance of the proceeds thereof, is any, shall be equally divided among the children of James H. Offutt, Esli Offutt, and Samuel Offutt, deceased. I desire also that it be distinctly understood that the legacies and property willed and bequeathed herein, except the boy Daniel given to my son,, Littleton Offutt to remain in possession of my, wife, Leannah during here widowhood and that after that time to be disposed of as herein stated by my executor.

I do hereby constitute and appoint Willis Warrinner, executor of this my last will and testament, and that he is and will be allowed to act as such without security. Done this 3rd day of August, A.D. 1853
