Widow's Pension - Affidavit of Witnesses.

State of Kentucky, County of Fayette,
     On this 7th day of January, A.D. 1895 Personally appeared before me a Notary public in and aforesaid County and State duly qualified to administer oaths J. E. Hanna aged 49 years residing at General Delivery, Lexington, Fayette County, KY and Timothy D??????n, aged 71 years residing at No. 207 S. Broadway ST. Lexington, KY persons whom I certify to be respectable and entitled to credit and who being by me duly sworn state that we were acquainted with Samuel H. Offutt. Deceased, who was a soldier in Co. C, of Missouri Vol Mounted having known him at least 40 and 8 years before his death, which occurred on the 19th day of Sept 1894, in Lexington, Kentucky, We know this to be true by reason of being present at his funeral. We also are well and personally acquainted with Sarah J. Offutt, widow of said Samuel H. Offutt, having known her for the last 40 and 8 years, and have lived as neighbor to her in Lexington, KY for the last 40 & 8 years and we have every reason to believe and we do believe that the said Sarah J. Offutt has not remarried since the death of her said husband. We further certify that if she had remarried our frequent intercourse and relations with her would have enabled us to have known or heard of it.

For the matter of Pension claim of Sarah J. Offutt. Widow of Samuel H. Offutt deceased, who was a Corporal in Co. C. Mounted Missouri Volunteers War with Mexico. On this 17th day of January A.D. 1895 personally appeared before me a Notary Public within and aforesaid County and State duly qualified to administer oaths. Mrs. Sarah J. Offutt who being by me duly sworn states that she is the aforesaid Sarah J. Offutt and widow of aforesaid Samuel H. Offutt on whose account she has applied for pension and it is impossible to provide a certified copy of marriage of said Samuel H. Offutt and myself for the reason that the court house was burned and records which contained said certificate and lisence were destroyed, this court house was in Paris, Bourbon County, Kentucky. I ask that the proof of two eyewitnesses to said marriage be accepted in lieu of said certified copy.

Declaration of Widow for Pension

State of Kentucky, County of Fayette SS:

On this 31st day of Dec 1894 personally appeared before me a Notary Public in and for the state and County aforesaid duly qualified to administer oaths, Sarah J. Offutt a resident of Lexington in the County of Fayette and State of Kentucky. Who being by me first duly sworn according to law, and says, I am the widow of Samuel H. Offutt, who served under the name of Samuel H. Offutt was a Corporal in Company C. Regiment of Missouri Mounted Volunteers, Commanded by Capt. Moran in the War with Mexico, that my said husband enlisted at Platte Co., MO on or about the day of 1846 for the term of 1 year, that I was married under my name of Sarah J. Vaughn to my said husband by, Rev. Mr. Sta???? On or about 24th day of October 1850 in Bourbon County, Kentucky and lived with my said husband from the date of said marriage until the day of his death, to wit the 19th day September A.D. 1894 which occurred in Lexington, in the State of Kentucky and that I have not since remarrried: that there was never any legal impediment to said marriage. That my said husband being duly enlisted as aforesaid actually served sixty days with the army of the United States in the war with Mexico. That in support and proof of my right of pension, I tender herewith under the regulations prescribed by the secretary of the Interior, the following evidence

that I am 65 years of age, and that I was born about the 18th day of Nov_ 1829 at Centerville in the State of Ky, County of Bourbon. That I make this application for pension under the Act of Congress of United States granting pensions to widows of soldiers of war with Mexico, approved January 29, 1887.
That I have not heretofore applied for or received a pension. That my said husband was a pensioner of United States for wound received at on Frontier, or in New Mexico and at said date of his death was on pension rolls under certificate No. 8044 and paid by Louisville Agency at the rate of $16.00 per month for gunshot wound in his right foot.
     And for such further evidence necessary to complet military services of my said husband I respectfully reqire to evidence heretofore furnish by my said husband and now on file in Pension Bureau at Washington DC that since the death of my said husband I have lived in Lexington, Kentucky. That neither myself or said husband had been married before we married each other. That I am not laboring under any political disabilities imposed by the 14th Amendment to the Constitution of the United States, and I hereby appoint with full power of substitution and revocation J. R. Spiers of Lexington, Ky my true and lawful attorney to prosecute my claim. My Post Office address is No. 180 S. Broadway St, Lexington, Ky.

Offutt, the claimant sign her name to aforegoing declaration, and that they have every reason to believe from the appearance of said claimant and their acquaintance with her for 8 years and 40 years that she is the identical person she represents herself to be and that they are totally disinterested in this claim_

     Be it remembered that on this second day of June in the year One Thousand Eight hundred and fifty four before me the undersigned Benjamin F. Graves Presiding Judge of the county court for the county and state aforesaid personally appeared Samuel H. Offutt aged 29 years as resident of the county of Bourbon in the State of Kentucky who being first duly sworn according to law declares and says that he is the identical Samuel H. Offutt who was a Corporal in the company commanded by Captain Jesse Morin, Company C in the Regiment or Battalion of Missouri volunteers commanded by Col.s Price and Willock That he was mustered into the service of the United States at Fort Leavenworth Missouri River Indian territory sometime in the month of July AD 1846 for the term of twelve months that on or about the 3d day of August AD 1846 the company left Fort Leavenworth on the rout to Santafee and on the day of October AD 1846 he thinks they arrived in Santafee New Mexico and that said company performed various duties in New Mexico for the space of about twelve months about which time they commenced their return home to the place from whence they started and that on the 4th day of September 1847 on the plains between Santafee and Fort Levansworth about three hundred and fifty miles from the later place called Coon Creek the company having encamped there for the night that he was engaged in preparin supper and on his way to the creek to procure water it being very

dark and on the way to the creek the sergant of the company and one of his mess had striped his horse and left the saddle on the ground his muskett the muzzle on the sadle and the bretch on the ground he was in the act of steping (not seeing the sadle or gun) he struck his right foot against the muzzle of the gun and it fired off the Ball and three buckshot passed through his right foot entering in front of the instep passin through ending a little outwards to the right. He was on his way to the Creek for water for the mess as aforesaid and in the line of his duty that he was conveyed from thence in a swing bed in a wagon to Fort Levansworth at which place they arrived about the latter part of September where he was met by his Father and taken home that his pay and an Honorable discharge was sent to him at his Fathers during the time he was there confined with said w???nt that he was confined at his Fathers by reason of said wound from six to eight months that he remained in Missouri until about the year 1850 he the came to the State Kentucky that he has made several trips to the State of Missouri and for the last two years he has been located permantly in Bourbon County Kentucky. That said wound has never been cured or healed up sometimes it is beter for a short time a great many bones small particles have some out at times and it constantly runnig, nearly all the time and is at this time soar and running. That there is but little or no difference for the 3 or 4 years at times now it is qute painful and that it totally disqualifies him from performing and

hard labor and that he is entirely disqualified from walking or from performing military duty or from earning his living from manual labor that he is a citizen of the United States born in the county of Jessamin and State of Kentucky. That he desires if a pension is allowed him to have the payments made at the agency at Louisville Kentucky. He hereby requests the pension agent to send the pension certificate and all communications addressed to him at Centerville Bourbon County and State of Kentucky

Offutt and their acquaintance with him that he is the identical person he represents himself to be and that they said James H. Shr??shire and

George H, Whitney do reside in the county and state aforesaid Doctor George H. Whitney further swears that he has known said Samuel H. Offutt from 12 to 15 years past and that he was informed at the time that said Samuel H. Offutt volunteered in the ????????? as is ?????? in his declaration and that he has been a regular practicing Physician and practiced in the family of said Offuts father some 12 to 15 years ago before he removed to Missouri and knew said Samuel H. Offutt well at that time, and that he has this day examined the wound of said Samuel H. Offutt in his right foot and has examined the same at various times before this and that he has prescribed for said wound me????? and that on all of his encounters he has found said wound in a sore running condition and at times small particles of bones would come from said wound. He considers said wound a permanent and totally disability and renders said Samuel H. Offutt incompetent from performing Military duty or manual labor.
James H. Shr??shire states that he has known said Offutt for about five years
